What is Legal Malpractice?

Legal malpractice occurs when a lawyer negligently or intentionally fails to properly represent the interests of their client. Lawyers can commit legal malpractice by failing to file a lawsuit before the statute of limitations, by missing an important court filing, or by working the case in a negligent manner. The law requires attorneys to adhere strictly to ethical standards within the practice of law, a departure from these standards can indicate the attorney has committed legal malpractice. Many legal cases have such high stakes and involve such large sums of money that carrying legal malpractice insurance is absolutely necessary.
